Parental Alienation (5) (Epoch Making New Law)

We obtained the epoch making visitation judgment.

In this case, the minor child was taken away by his mother without his father’s consent.  She then filed a divorce mediation for domestic violence by his father against the mother and the child. After the family court investigation, the investigator recommended not to commence visitation because of the firm refusal of visitation by the minor child. We challenged the family court investigator’s recommendation.  The judge admitted our argument and rendered the visitation order.  It is very rare for the Family Court not to follow the recommendation of the family court investigator.

Please see more detail in the court finding and court reasoning.  We believe this is the first case substantially accept the parental alienation of the mother.
